Pre-nuptial agreements
Over the last few years pre-nuptial agreements have become increasingly common. Although still not binding on the courts they are increasingly persuasive and, provided that they have been expertly prepared and drafted they are likely to very influential in any subsequent divorce proceedings. They are worth considering particularly if one party is bringing into the marriage pre-existing assets that they wish to try to protect. We recognise that advising in this area requires a sensitive, non-confrontational approach whilst at the same time representing the client’s best interests and we have the skill sets to provide this type of service.
